EULA - End User License Agreement

NOTICE TO USERS: CAREFULLY READ THE FOLLOWING LEGAL AGREEMENT. USE OF THE SOFTWARE PROVIDED WITH THIS AGREEMENT (THE "SOFTWARE") CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT INSTALL AND/OR USE THIS SOFTWARE. USER'S USE OF THIS SOFTWARE IS CONDITIONED UPON COMPLIANCE BY USER WITH THE TERMS OF THIS AGREEMENT. SHARING THIS SOFTWARE WITH OTHERS IS A VIOLATION OF THIS EULA.

Your license confers no title or ownership in the SOFTWARE and should not be construed as a sale of any right in the SOFTWARE.

Anyone may use this software during a trial period of 30 days. Following this trial period of 30 days, if you wish to continue to use THE SOFTWARE, you MUST register. The trial version of "Exam" software may be freely distributed, provided the distribution package is not modified.

One registered copy of "Exam" software can be installed only on a single workstation. In case of network use, licensee agrees to purchase site licenses or at least the total number of single copies of this software to equal or exceed the total number of network stations on which "Exam" software resides. The registered "Exam" software may not be rented or leased.

Licensee acknowledges that monetary damages may not be an adequate remedy for any breach or violation and agrees that, in addition to any other remedies at law, www.exam-software.com shall be entitled to obtain injunctive relief from a court of competent jurisdiction to restrain any such breach or violation. In case of disputes concerning this EULA, prevailing party may recover its reasonable attorney's fees and costs from losing party.

YOU CAN DISTRIBUTE/SELL YOUR OWN .EXM FILES (i.e. QUESTION BANK) CREATED USING REGISTERED "EXAM" SOFTWARE TO ANYONE. UNDER NO CIRCUMSTANCES ARE YOU LICENSED TO DISTRIBUTE .EXM FILES CREATED BY THE TRIAL VERSION OF "EXAM" SOFTWARE. DISTRIBUTION OF REGISTERED VERSION OF "EXAM" SOFTWARE IS PROHIBITED.

You may not use, copy, emulate, clone, rent, lease, sell, modify, decompile, disassemble, otherwise reverse engineer, or transfer the licensed program, or any subset of the licensed program, except as provided for in this agreement. Any such unauthorized use shall result in immediate and automatic termination of this license and may result in criminal and/or civil prosecution.

WWW.EXAM-SOFTWARE.COM DISCLAIMS ALL OTHER WARRANTIES WITH RESPECT TO THE SOFTWARE, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT OF THIRD PARTY RIGHTS.
